We share data only with trusted third-party platforms (e.g., HubSpot, Stripe, analytics tools) necessary for our operations. All vendors are GDPR/CCPA compliant.

5. Data Retention

We retain report-related data for internal reference and refinement, unless you request deletion. Marketing data is retained until opt-out.

Under GDPR and CCPA, you may:

By accessing or using ElevateForward.ai (“ElevateForward,” “EF,” “we,” “our,” or the “Service”), you agree to these Terms of Service (“Terms”). These Terms govern your access to and use of all ElevateForward.ai products and services, including strategic insight reports, software applications, subscriptions, tools, dashboards, and related assets.

1. Use of Services
You may access and use the Service solely for your internal business purposes. All reports, software, and platform access are licensed, not sold. You may not resell, sublicense, redistribute, publish, or otherwise exploit the Service or its outputs without written authorization from ElevateForward.ai.

2. Software Application Access
ElevateForward.ai provides access to a proprietary software application that enables users to generate, store, manage, and analyze strategic insights and reports.

• Access to the application is provided on an “as-is” and “as-available” basis.
• We do not guarantee uninterrupted availability, uptime, or error-free operation.
• Features, functionality, and availability may change over time.

3. Intellectual Property
All intellectual property rights in the Service—including software, reports, frameworks, methodologies, workflows, prompts, templates, and presentation formats—remain the exclusive property of ElevateForward.ai.

You retain ownership of data you submit. By using the Service, you grant ElevateForward.ai a limited license to process your inputs solely for the purpose of delivering the Service.

4. Restrictions on Use
You agree not to:

• Reverse engineer, decompile, scrape, or replicate any part of the Service
• Use the Service to train AI models or create competing products
• Misrepresent ownership of EF materials
• Access the Service in a manner intended to bypass limits, safeguards, or pricing tiers

Violation may result in immediate suspension or termination.

5. Accounts & Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account.

6. Disclaimers
The Service provides strategic insights and informational outputs only. ElevateForward.ai does not guarantee business outcomes and does not provide legal, financial, or professional advice.

7. Limitation of Liability
To the maximum extent permitted by law, ElevateForward.ai shall not be liable for indirect, incidental, or consequential damages. Total liability shall not exceed the amount paid to ElevateForward.ai for the applicable Service during the prior twelve (12) months.

8. Governing Law
These Terms are governed by the laws of the State of Texas. Venue shall be Travis County, Texas.

9. Updates
We may update these Terms periodically. Continued use constitutes acceptance of the revised Terms.

Applies To: Authorized partners, resellers, and consultants.

1. Grant of License
ElevateForward.ai grants Partner a non-exclusive, non-transferable license to access EF reports and, where authorized, the EF application, solely for use in delivering services to Partner’s clients.

• Reports may be used only within active client engagements
• Redistribution beyond intended client use is prohibited
• Application access is licensed for delivery enablement only and may not be resold

2. Ownership & IP
All ElevateForward.ai intellectual property remains the sole property of EF. Partner may not replicate, reverse engineer, or extract EF frameworks, software logic, or methodologies.

3. Permitted Use
• Co-branding or white-labeling of reports only with written approval
• Limited edits allowed for tone or client context
• The EF application may not be white-labeled unless governed by a separate enterprise agreement

4. Monitoring & Compliance
EF reserves the right to monitor usage and audit compliance. Abnormal or abusive use may result in suspension or termination.

5. Termination
EF may revoke access for breach, misuse, or reputational harm. Upon termination, Partner must cease use and destroy all EF materials.

6. Liability
EF provides strategic guidance only. Partner assumes responsibility for client outcomes and delivery.

Applies To: Consultants, agencies, and businesses purchasing EF subscriptions or credits.

1. Subscription Access
By purchasing a subscription, you receive:
• Access to the ElevateForward.ai software application
• Feature availability based on plan tier
• The ability to generate and manage reports using available credits

2. Use Restrictions
You may not:
• Resell reports or software access
• Use EF outputs outside direct client engagements
• Modify or extract core frameworks or workflows

3. Credit Terms
• Credits are valid for 12 months
• One credit equals one report
• No refunds on used credits
• Two revisions per report included within 7 days from the original report being produced

4. Billing, Cancellation & No Proration
Subscriptions are billed in advance on a monthly or annual basis.
• You may cancel at any time
• Cancellation stops future billing only
• No prorated refunds for unused subscription time

5. Confidentiality & Data Use
You agree to maintain confidentiality of EF materials and client data. EF processes data solely to deliver the Service.

At ElevateForward.ai, we stand behind the quality and clarity of every report we deliver. By purchasing or using credits, you agree to the following terms, which are designed to ensure transparency, fair use, and legal protection for both parties.

1. Credit Purchase and Usage

  • Each insight report requires one credit, which may be purchased individually or in discounted packages.

  • Credits are tied to the email address/account used at the time of purchase and are valid for 12 months from the date of purchase.

  • Unused credits expire after 12 months and are not eligible for a refund after the expiration date.

  • Credits are transferable upon request to other users within the same organization or to another business entity related to the purchaser (e.g., in case of mergers, acquisitions, or internal reorganization). Transfers must be requested in writing to support@elevateforward.ai and will be reviewed for approval.

  • Credits may be used for any current or future ElevateForward.ai product unless explicitly excluded by product-specific terms.

2. Report Delivery and Revision Policy

  • Every report includes one revision cycle, which must be requested within 7 calendar days of the initial report delivery.

  • Revisions may address:

    • Clarification of provided inputs

    • Minor scope adjustments

    • Factual or data inconsistencies

  • Revisions do not include changes to the original intake form information (e.g., changing project goals, audience, product focus, or messaging direction). Substantial scope changes will require the use of an additional credit.

  • If no revision request is received within 7 days, the report will be considered final and closed.

3. Software Subscriptions

  • Subscription fees are non-refundable

  • No prorated refunds for partial months

  • Access continues through the paid term only

4. Refund Policy

  • Credits that have been applied to a report are non-refundable.

  • Unused credits may be refunded within 14 days of purchase upon request. After that period, all sales are final.

  • Refunds must be requested via email to support@elevateforward.ai, and must include the purchaser’s email, payment details, and order confirmation number.

  • Approved refunds will be issued to the original payment method unless otherwise agreed in writing.

5. Report Access and Team Use

  • Reports are shareable within your organization and may be distributed internally for business use.

  • Credits are associated with individual user accounts, not pooled across teams unless part of a custom enterprise agreement.

  • Reports may not be publicly redistributed, sold, or repurposed outside your organization without written permission from ElevateForward.ai.

6. Disclaimers and Limitation of Liability

  • Reports generated by ElevateForward.ai are based on data and inputs provided by the user and industry-informed models. They are intended for informational purposes only and do not constitute legal, financial, or business advice.

  • You are solely responsible for evaluating and acting upon the contents of any report.

  • To the fullest extent allowed by law:

    • We disclaim all warranties, express or implied, including merchantability or fitness for a particular purpose.

    • We are not liable for indirect, incidental, punitive, or consequential damages, including but not limited to loss of business, revenue, or data.

  • Our total liability under any claim shall not exceed the total amount paid by you for the specific credit(s) or report(s) giving rise to the claim.

7. Governing Law

These terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any disputes arising under these terms shall be resolved in the courts of Travis County, Texas, unless otherwise agreed in writing.

8. Updates to These Terms

We may update these Terms of Use from time to time. The current version will always be available at elevateforward.ai/legal-privacy. Continued use of our services after an update constitutes acceptance of the revised terms.

California residents have additional rights under the CCPA, including the right to:

  • Know what personal information we collect and how we use it

4. Data Security and Storage

Your information is securely stored and processed using trusted third-party platforms (e.g., HubSpot, Stripe) with strong safeguards in place. We do not sell or disclose your personal data to unauthorized third parties.

This Acceptable Use Policy (“Policy”) governs the use of all ElevateForward.ai (“ElevateForward,” “EF,” “we,” or the “Service”) software, applications, reports, tools, dashboards, and related services. This Policy is incorporated by reference into the ElevateForward Terms of Service.

By accessing or using the Service, you agree to comply with this Policy.

1. Permitted Use
You may use the Service solely for:
• Internal business analysis and planning
• Client delivery within authorized consulting engagements
• Lawful business purposes aligned with your subscription or license

All use must comply with applicable laws and these policies.

2. Prohibited Uses

You may not, directly or indirectly:
A. Platform Abuse & Circumvention
• Attempt to bypass usage limits, pricing tiers, or safeguards
• Share account credentials outside your licensed organization
• Create multiple accounts to evade restrictions

B. Intellectual Property Misuse
• Reverse engineer, decompile, or extract EF software logic, workflows, prompts, or frameworks
• Replicate, copy, or repackage EF outputs as competing products
• Misrepresent EF materials as your own proprietary system

C. AI & Automation Restrictions
You may not:
• Use EF outputs, reports, or workflows to train machine learning or AI models
• Use automated tools, scripts, bots, or scraping mechanisms to access or extract EF content
• Systematically harvest or store EF outputs beyond normal business usage

D. Competitive or Benchmarking Misuse
You may not:
• Use the Service to build, evaluate, or validate a competing platform
• Perform internal benchmarking of EF for resale, replication, or third-party comparison tools
• License, sublicense, or commercialize EF frameworks outside authorized agreements

E. Data & Security Violations
You may not:
• Upload malicious code, malware, or harmful content
• Interfere with system performance or integrity
• Access data belonging to other users without authorization

3. Fair Use & Reasonable Consumption

ElevateForward.ai reserves the right to monitor usage patterns to ensure fair use. Excessive, abnormal, or abusive usage may result in:
• Throttling
• Temporary suspension
• Plan adjustment recommendations
• Termination in cases of repeated or egregious abuse

4. Enforcement
Violation of this Policy may result in:
• Immediate suspension or termination of access
• Revocation of licenses or subscriptions
• Legal action where appropriate

ElevateForward.ai may take action without prior notice to protect the integrity of the platform.
